About these terms

These Terms of Use describe the proposed conditions for using Mexeu, developed by Daniel Otaviano Bezerra Pontes, an independent developer operating as an individual and based in Lisbon, Portugal. Contact: info@mexeu.com.

These terms are intended to take effect when Mexeu becomes available on the App Store. The final version must be completed before launch, with the corresponding date recorded on this page. This draft does not take effect while marked as a draft.

The final version must be available before purchase. When using or purchasing the service, you should have an appropriate opportunity to review and accept applicable terms. The Privacy Policy explains data processing; accepting these terms does not automatically authorize data uses requiring separate consent.

What Mexeu provides

Mexeu combines movement activities and math challenges with minutes of access to apps you select. It may also provide alarms, daily progress and personalization, depending on the version and your purchased access.

Minutes are an internal usage-control feature. They are not money, financial credit or a promise of benefits outside the app, and cannot be sold or exchanged for cash.

Availability and compatibility depend on your device, iOS version, permissions, Apple services and, for offers and purchase verification, network access. Features and conditions included in each plan must be described in the purchase offer.

Who can use Mexeu

You must be 16 or older. If you are not legally able to enter into a purchase contract, a subscription requires your parent’s or guardian’s authorization as required by applicable law and App Store rules.

The app does not require an email and password account. A local installation identifier supports its operation; purchases are associated with your Apple Account and the store’s restoration rules.

Move safely

Mexeu is a habits and wellness tool. It does not provide medical care, diagnosis or treatment and does not replace professional health advice. It does not promise weight loss, fitness, addiction treatment or clinical outcomes.

Only perform activities appropriate for your condition in a safe space. Stop if you experience pain, dizziness, unusual shortness of breath or other discomfort. Seek professional advice when needed. Camera counting can be inaccurate and does not assess whether an exercise is safe for you.

Do not use the app while driving or in situations requiring attention to safety. This guidance does not exclude liability imposed on us by law.

Camera, alarms and Screen Time

You control permissions in iOS Settings. The camera supports local movement counting; Screen Time features apply restrictions to apps you select. Revoking a permission may make its related feature unavailable.

Alarms, restrictions and counters depend on technical system conditions and may be delayed, interrupted or inaccurate. Do not rely on Mexeu as your only alarm for a critical situation, such as medication, emergency care or safety.

Keep ways to access essential device features. Mexeu is a personal habits tool, not a surveillance or emergency control system.

Plans and purchases

Price, currency, duration, included features and any trial are those shown in the purchase screen and App Store confirmation. Taxes and payment methods follow the offer and local store rules. Review these details before confirming.

Apple processes payments. PRO access depends on confirmation of a valid purchase or other legitimately granted access. A pending purchase may not unlock access until approved. Use “Restore purchases” with the Apple Account used for the purchase.

If a lifetime offer is made, it must clearly define what is included and what “lifetime” means before purchase. These terms do not turn recurring subscriptions into lifetime purchases or create an unavailable offer.

Renewal and trials

If an offer is an auto-renewing subscription, the App Store renews and charges under the conditions shown at purchase. A free trial, when offered, may convert into a paid subscription at its end unless you cancel within the store’s stated deadline.

To avoid another charge, cancel before Apple’s stated deadline — usually at least 24 hours before the period ends, including a trial. Do not wait until the last moment. Price changes follow the notices, approvals and cancellation rights required by the App Store and applicable law.

Cancellation and refunds

Manage or cancel a subscription through iOS Settings → your name → Subscriptions → Mexeu, or the App Store subscription area. Access after cancellation follows the paid period or trial conditions shown by Apple.

Deleting the app, revoking permissions or requesting data deletion does not cancel your subscription. Refund requests for App Store purchases can be started at reportaproblem.apple.com. Store review does not remove mandatory legal rights or prevent you from contacting us.

Applicable withdrawal, cancellation and refund rights in Brazil, the European Union, United Kingdom and other countries remain in force. Exceptions for digital content or services depend on legal conditions, including express consent and acknowledgment where required; merely using the app is not a general waiver.

Permitted use and license

You receive a personal, non-exclusive license to use the app on compatible devices under these terms and App Store rules. The name, visual identity, code and content remain with their respective owners.

Do not use the service for unlawful activities, purchase fraud, deliberate exploitation that harms other people or services, unauthorized app distribution or infringement of third-party rights. Restrictions do not prohibit legally permitted activities, including interoperability, research or other applicable exceptions.

Using another person’s device requires legitimate authorization. Do not attempt to use Mexeu to monitor or restrict someone else without authorization.

Privacy and local data

The Privacy Policy describes local camera and preference processing and data sent to Mixpanel, Superwall and Apple. Use of those services means that not all app processing is local.

Local data may be lost through app removal, device failure or backup and restore changes. Restoring purchases does not guarantee recovery of progress or settings. This version does not promise cloud synchronization.

Updates and availability

We may update the app to fix issues, maintain compatibility or improve features. Material changes to paid services or these terms require appropriate communication and respect for contracted rights and applicable law.

A suspension for fraud or unlawful use should be proportionate. Where feasible and permitted, we will explain the reason and ways to challenge it. If a change or closure affects a paid period, refunds or other remedies required by law will be preserved.

Changes do not retroactively remove acquired rights. The final version will state its update date and obtain new valid acceptance when necessary.

Liability and your rights

We aim to provide a functioning service and resolve issues, but movement counting, restrictions, alarms and external services may have limitations. These limitations do not remove legally required quality, conformity, remedies or warranties.

Nothing excludes liability for intentional misconduct, gross negligence, death or personal injury where legally protected, or other rights that cannot be limited. These terms do not impose a general waiver of consumer rights or unlimited user indemnification.

Applicable law and disputes

Because the developer is based in Portugal, these terms propose Portuguese law. This choice does not deprive consumers of mandatory protections in their country of residence where applicable.

You retain access to competent courts, data protection authorities and consumer protection bodies. We do not impose mandatory arbitration or an exclusive court that removes your local rights.

Apple conditions

For the app obtained through the App Store, Apple’s standard End User License Agreement also applies, unless a valid custom license is provided in the store. These terms supplement the service relationship and do not seek to replace that agreement with a custom license.

Apple is not responsible for our app support. Store conditions and mandatory consumer rights continue to apply. If there is a conflict, Apple’s license governs licensing matters and these terms govern the service, always subject to applicable law.
